Terms of Service

1. Who Can Use Bashly

You must be at least 13 years old to use this Service.

If you are under 18, you must have the consent of a parent or guardian before creating or publishing an event. We will request guardian approval as part of the onboarding flow in compliance with the South African Children's Act and POPIA.

By using the Service you confirm that the information you provide is accurate and that you have the authority to agree to these Terms on behalf of yourself (and, where applicable, with guardian consent).

2. The Service

Bashly is a WhatsApp-based AI assistant that helps you:

• Plan and organise events (birthdays, matric dances, braais, house parties, etc.)
• Generate shareable Party Pack pages with RSVP, gift board, and venue directions
• Collect guest RSVPs and dietary requirements via WhatsApp
• Send automated reminders and updates to guests

The Service is currently operated as a concierge model — human operators may assist in managing your event. We reserve the right to change, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Your Responsibilities

You agree to:

• Provide accurate event and contact details
• Obtain consent from guests before sharing their WhatsApp numbers with us
• Use the Service only for lawful purposes
• Not use the Service to send spam, unsolicited messages, or harmful content
• Not attempt to reverse-engineer, scrape, or abuse the Service

You are responsible for all activity that occurs through your WhatsApp number in connection with the Service.

4. Payments

Certain features may require payment. All payments are processed by PayStack, a PCI-DSS compliant payment provider. We do not store your card details.

All prices are in South African Rand (ZAR) and inclusive of applicable taxes unless stated otherwise.

Refunds are handled on a case-by-case basis. To request a refund, contact us at hello@bashly.io.

5. Content

You retain ownership of any content you submit (event details, photos, messages). By submitting content you grant us a limited, non-exclusive licence to use it solely to operate and improve the Service.

We reserve the right to remove content that violates these Terms or applicable law, including content that is unlawful, harmful, or offensive.

6. Privacy and Data Protection

We process personal information in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA). Data is stored exclusively in South Africa (Supabase af-south-1 region).

7. WhatsApp and Meta Platforms

The Service operates via the WhatsApp Business API, subject to WhatsApp Business Terms of Service and Meta Platform Terms.

We are not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or WhatsApp LLC.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by South African law, FiftyKnots Studio (Pty) Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, missed events, or guest communication failures.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We will notify users of material changes via WhatsApp or the website.
